Terms of Service
Last updated 18 October 2026.
Mingleround is operated by Merkenberg, a sole proprietorship based in the Netherlands. By using Mingleround, as an organizer or as a participant registering through an event link, you agree to these terms.
Who we are
- Merkenberg, the sole proprietorship (eenmanszaak) of C.J. Bodbijl, the Netherlands
- Address: Reestraat 5-1, 1016 DM Amsterdam
- E-mail: info@mingleround.app
- Chamber of Commerce (KVK): 82826218
- VAT number: NL003735674B80
The service
Mingleround lets organizers run matchmaking and networking events, in person or online: registration, rounds, generating pairings or groups, letting participants privately express interest in a match, a one-way release of mutual matches, check-in, conversation games, chat between matched participants and, as an optional add-on, video rounds with optional keepsake recordings. We provide the software; the organizer is responsible for the event itself: its safety, its venue, who they invite, and how they run it.
Eligibility
You must be 18 or older to register for an event or create an organizer account.
Organizers, and business use only
Organizer accounts are for people acting in the course of a trade, business or profession. By creating an organization you confirm that you do. An organizer decides whom to invite and is responsible for the people they add or import and for the lawfulness of that. Participants never pay Mingleround anything.
Plans and prices
Prices are in euros. These are the plans an organization can choose in Settings:
- Trial: free. One event, up to 50 real registrations. It does not turn into a paid plan by itself.
- Starter: €1.50 per real registration, no monthly fee. Charged once per event when the organizer finalizes its registrations; pairings for that event can only be locked once it is paid.
- Pro: €249 per month, including 250 registrations per billing period.
- Business: €599 per month, including 1,500 registrations per billing period.
- Video add-on, on top of Pro or Business: €99 per month, including 1,000 participant-minutes per period (one person in a call for one minute, counted from the round length when a round starts), then €0.10 per extra minute.
- Enterprise: agreed individually.
On Pro and Business, registrations beyond the included number cost €1.50 (Pro) or €1 (Business) each, but only if an owner or admin switches on "Allow extra registrations" in Settings. Without it, registration for that organization stops when the included number is used. A registration counts once, when it is created: test and preview registrations do not count, and deleting a registration does not give it back.
Payment, VAT and invoices
Payments are made through Stripe, our payment provider, which receives the payment details; we never see your card number. The price shown is the amount charged at checkout. Checkout does not add VAT on top of the price and does not currently show a separate VAT amount. Our VAT number is NL003735674B80. For a question about VAT or an invoice, including as a business in another EU country, write to info@mingleround.app. Subscription invoices and payment history can be opened under Manage billing in Settings.
Renewal, cancellation and refunds
- Pro, Business and the Video add-on are monthly subscriptions. They renew automatically every month until cancelled.
- An owner or admin cancels in Settings under Manage billing (the add-on has its own "Manage or cancel the add-on"). The billing portal shows when the cancellation takes effect. We do not refund the period already started or the part of it that is unused.
- Switching between Pro and Business applies immediately; the difference is prorated by Stripe on your next invoice.
- When a subscription ends, whether by cancellation or because Stripe stopped trying to collect payment, the same 7 days apply as for a failed payment (next paragraph). Your data stays until you delete it.
- Starter is paid per event when registrations are finalized. If a Starter payment is refunded in full the event counts as unpaid again and its pairings cannot be locked until it is paid. A partial refund does not change that.
- Deleting an organization cancels its subscriptions immediately, with no refund for the current period. Payment records are kept for 7 years because tax law requires it.
If a payment fails
If a subscription payment fails, Stripe retries it. From the first failure you have 7 days to resolve it in Settings. After that, new events cannot go live and matching cannot start until payment is resolved. Payment stays possible from Settings throughout.
Right of withdrawal for consumers
Mingleround is sold to businesses. If, despite what is said above, you are a consumer, you have the right to withdraw from a paid plan within 14 days without giving a reason (Articles 6:230g to 6:230z of the Dutch Civil Code), by e-mail to info@mingleround.app. By starting a paid plan you ask us to begin providing the service immediately. If you then withdraw within the 14 days, you pay a proportionate amount for what has been provided until you told us. For a service that has been fully performed within the 14 days at your express request, with your acknowledgement that you lose the right of withdrawal once it is fully performed, the right ends when it is fully performed.
Participants
You're responsible for the accuracy of the information you provide: your name, contact details and meeting preferences. Registering for someone else's event does not create a contract with us for which you pay; the organizer is responsible for the event. How we and the organizer handle your data is in the Privacy Policy.
Content and conduct
People can add content to Mingleround: names, profile details, photos, answers, messages in a chat between matched participants, notes in conversation games, and, for organizers, event descriptions and organization profiles. Do not use Mingleround to harass, threaten or stalk anyone, to share sexual content involving minors, to impersonate another person, to publish someone else's private information, to share anything illegal, or to send unsolicited advertising. Do not enter or import a person who has not agreed to be there.
We do not read private content as a matter of course. If we learn of content or conduct that breaks these terms or the law, we can remove or restrict it, suspend or end the account concerned, and tell the organizer of the event. When we do this we say why, unless the law prevents it, and the person concerned can reply to that message to object.
Reporting illegal content, and contacting us (Digital Services Act)
Mingleround stores content that its users provide, so it is a hosting service under Regulation (EU) 2022/2065 (the Digital Services Act).
- Point of contact for the authorities of EU Member States, the European Commission and the European Board for Digital Services (Article 11), and for users (Article 12): info@mingleround.app. Write in English.
- Report content you believe is illegal (Article 16) to the same address. Include why you think it is illegal, where it is (the event and the person's name, or the link of the page), your name and e-mail address (not needed for a report about child sexual abuse material), and a statement that you believe in good faith that your report is accurate and complete. We confirm receipt, assess the report with care, and tell you what we decided and how to object.
- If we act because of a report (Article 17), we tell the person whose content or account is affected what we did and why, unless the law prevents it.
- Inside a chat, a participant can also report a conversation to the organizer. That report does not carry the messages and goes to the organizer, not to us.
Personal data
For the data of the people an organizer registers or invites, the organizer is the controller and we are its processor; the Data Processing Agreement in Annex A applies, and an owner accepts it when creating an organization. For participant accounts, chat, keepsake recordings, conversation-game notes, the reminder e-mails Mingleround sends, and our own analytics, security and billing records, Mingleround is the controller; see section 14 of Annex A for who does what, and the Privacy Policy for the details.
Accessibility
We want Mingleround to be usable by everyone. See our Accessibility statement and how to tell us about a problem.
No warranty
Mingleround is provided "as is," without warranties of any kind, express or implied. We don't guarantee the matching algorithm will produce any particular outcome, that the service will be uninterrupted or error-free, or that any event run through it will go as planned.
Limitation of liability
To the fullest extent permitted by law, Merkenberg is not liable for any indirect, incidental, or consequential damages arising from your use of Mingleround, or from anything that happens at an event organized through it. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability for intent or deliberate recklessness, or anything else that cannot be limited by law, and mandatory consumer-protection rights are not affected.
Ending use of the service
You can stop using Mingleround at any time, and delete your registration, your account or your organization yourself. We may suspend or end an account that misuses the service, violates these terms, or puts other users at risk.
Governing law
These terms are governed by the laws of the Netherlands. Disputes will be handled by the competent Dutch court, without prejudice to any mandatory consumer-protection rights you have in your own country of residence.
Changes
We may update these terms as the product changes. We'll update the date at the top of this page when we do, and we'll e-mail the owners of organizations on a paid plan about a change that materially affects them before it applies. A new version of the Data Processing Agreement is shown to the owners of each organization to accept again.

Annex A: Data Processing Agreement (version 2026-10-26.1)
This Data Processing Agreement (version 2026-10-26.1) is between Merkenberg (KVK 82826218), the operator of Mingleround, as processor ("Mingleround", "we"), and the organization on whose behalf an owner accepted it in Mingleround, as controller ("the Organizer", "you"). It applies to the personal data we process for you when you run events through Mingleround, and forms part of the Terms of Service. If anything in this Annex conflicts with the rest of the Terms about personal data, this Annex prevails.
1. Roles
For the personal data of people you invite, add, import or receive registrations from through Mingleround, in order to run your events ("Participant Data"), you are the controller and we are your processor. You decide whom to invite and why; we process the data on your behalf and on your documented instructions.
For the data described in section 14 (participant accounts, chat, keepsake recordings, conversation-game notes, the reminder e-mails we schedule, and our own analytics, security and billing records) we decide the purposes and means ourselves and act as controller. The Terms and the Privacy Policy describe that.
2. Subject matter and duration
The subject matter is the provision of the Mingleround service described in the Terms. This Annex applies for as long as your organization exists in Mingleround and ends when the organization is deleted or the account relationship ends, after which section 10 applies.
3. Nature and purpose of the processing
We store and process Participant Data to let you run events: registration, check-in, generating and showing pairings and groups, collecting private yes or no answers and releasing results, sending reminders and notices to the people you registered, exports you request, and (where you switch it on) video rooms. We do not process Participant Data for our own purposes, do not sell it, and do not use it for advertising.
4. Types of personal data and data subjects
Data subjects: the people registered for your events, whether they registered themselves or you added or imported them.
Data types: name, e-mail address, optional phone number, meeting preferences (who the person is and whom they are open to meeting, using the categories you set for the event), optional profile details (age, pronouns, bio, interests, photo; in business events a LinkedIn address and work e-mail), registration status and check-in, pairings and group placements, and the person's private yes or no answers about meeting someone again. Which of these exist depends on how you set up the event.
Special categories: in dating events, the meeting preferences and the optional sexual-orientation field can reveal or state a person's sexual orientation (Art. 9 GDPR). We collect explicit consent for this directly on the public registration form and keep a record of it. For people you add by hand or import, you collect and are responsible for that consent and attest to it in the product; you must not enter or import a sexual orientation for anyone who has not explicitly consented.
5. Your instructions
We process Participant Data only on your documented instructions, which are: this Annex, the Terms, and the actions you and your team members take in the product (for example creating an event, adding or removing a participant, releasing results, exporting a list). We also process it where EU or Dutch law requires, and we tell you beforehand unless the law forbids that.
If we believe an instruction infringes data protection law we will tell you without undue delay.
6. Confidentiality
Everyone we allow to process Participant Data is bound to confidentiality. Mingleround is operated by a sole proprietor who is bound to confidentiality. We do not give anyone else access to your organization's data, apart from the sub-processors in section 8.
7. Security (Art. 32 GDPR)
We apply appropriate technical and organizational measures. At the time of this version they include: every table in the database is protected by row-level security scoped to the organization, so one organization's data is not readable by another; data is encrypted in transit (TLS) and at rest by our hosting providers; participants' personal links are stored only as hashes; individual yes or no answers are hidden from you in the database itself until you release results; chat between matched participants and keepsake recordings cannot be read by organizers at all; access to participant data by anonymous visitors is limited by rate limits; the application sets a strict content security policy; and our service credentials are kept as server-side secrets that we rotate after a suspected exposure.
We review these measures as the product changes. You are responsible for the security of your own accounts and devices, for who you give access to your organization, and for the files you export.
8. Sub-processors
You give us a general authorization to use the sub-processors listed below. We have a data processing agreement with each that places on it data protection obligations equivalent to this Annex.
We will tell the owners of your organization by e-mail at least 14 days before we add or replace a sub-processor. You may object on reasonable data protection grounds within that period. If we cannot resolve the objection you may end the agreement before the change takes effect and delete your organization.
- Supabase: Database, file storage and sign-in. Where: Paris, France (AWS eu-west-3). Transfer mechanism: Data is stored in the EU. Supabase's DPA incorporates the EU standard contractual clauses for any transfer outside the EU. Data: Everything stored by Mingleround: account data, organizer and participant data, messages, photos.
- Vercel: Hosting of the application; cookieless visit statistics (Vercel Web Analytics). Where: Functions run in Paris, France (cdg1). Vercel's primary processing facilities are in the United States.. Transfer mechanism: EU standard contractual clauses (Commission Decision 2021/914, module two) in Vercel's DPA. Data: Everything that passes through the application while a request is handled, including registration forms; visit statistics.
- Resend: Sending e-mail. Where: United States. Transfer mechanism: EU-U.S. Data Privacy Framework (Resend is certified under it, per its DPA). Data: Recipient address, name where used in the message, and the content of the message (for example the personal registration link).
- Stripe: Payments from organizers (plans and add-ons). Where: Stripe, LLC in the United States, as named in Stripe's DPA. Transfer mechanism: Stripe's data transfer addendum (EU-U.S. Data Privacy Framework and EU standard contractual clauses). Data: Organizer billing contact, organization name, plan, subscription and payment references. Never participant data, never card numbers on our side.
- Whereby: Video rooms for online events and optional keepsake recordings. Where: Whereby is a Norwegian company; data is stored in Ireland or another EU/EEA location (its sub-processor is Amazon Web Services EMEA SARL). Transfer mechanism: Storage in the EU/EEA; where a transfer is not covered otherwise, Whereby's DPA uses standard contractual clauses. Data: The display name a person joins with, audio and video during a call, and a keepsake recording if both people agree.
9. Assistance
Taking into account the nature of the processing, we help you answer requests from data subjects. Participants can already delete their registration, download their data, withdraw their consent for their sexual orientation and delete their account themselves, without your involvement. Tell us promptly if you receive a request we need to act on and we will help within a reasonable time.
We also help you, on request and within reasonable limits, with your security obligations, with a data protection impact assessment and with prior consultation of the supervisory authority.
We will tell you without undue delay, and in any case within 48 hours after we become aware of it, of a personal data breach affecting Participant Data, with the information we have (what happened, the data and people concerned, likely consequences, what we are doing) and further information as we learn it. You decide whether to notify the Autoriteit Persoonsgegevens and the people concerned; we help you do so.
10. Deletion and return
Owners and admins of your organization can export its participant lists at any time while it exists. When you delete your organization, we delete its Participant Data, including photos and, at our video provider, keepsake recordings. Copies held in our providers' routine backups expire under the providers' own schedules. We keep only what the law requires us to keep, for example payment records for 7 years, which are our own records as controller.
11. Information and audits
We make available the information needed to show we comply with Art. 28 GDPR. Once a year, on written request, we provide documentary evidence of our measures and, where we are allowed to share them, our providers' independent audit reports. Only if that is not enough do we allow an audit by you or an auditor bound to confidentiality, with reasonable notice, during normal hours, without disrupting the service and at your cost.
12. International transfers
We process Participant Data in the EU. Our hosting and e-mail providers may process it in the United States; each transfer relies on the mechanism named for that provider in the table below (standard contractual clauses or the EU-U.S. Data Privacy Framework). We do not transfer Participant Data elsewhere without a valid mechanism.
13. Liability
Liability under this Annex is governed by the limitations in the Terms of Service, without prejudice to what cannot be limited by law.
14. Features we control ourselves (Art. 26 GDPR)
Some features are not an extension of your administration: participant accounts that span several organizers, chat between matched participants, keepsake recordings of video calls, conversation-game notes, the reminder and notification e-mails that Mingleround schedules and sends, the unsubscribe list, retention of that data, and our analytics, security and billing records. You cannot see chat messages, recordings or game notes at all; they are visible only to the participants concerned. For these features Mingleround decides the purposes and means and is the controller, and informs the people concerned in its Privacy Policy.
You decide only whether to switch a feature on for an event (for example games or video rounds). If a supervisory authority or court were to regard you as a joint controller for that decision, then, as the arrangement required by Art. 26: Mingleround fulfils the information duties and handles requests of data subjects about these features and keeps the records and security for them; you do not receive the data; each of us may be contacted by data subjects, who can write to info@mingleround.app; and the essence of this section is available to data subjects on request.
